Man Is Suing Starbucks After ‘Scalding Tea’ Burns His Hands And Genitals Making Sex ‘Awkward And Painful’

A man is suing Starbucks after he received a drink which allegedly spilt onto his hands and genitals, leaving him with second and third-degree burns. 

Tommy Piluyev has filed a lawsuit against the coffee giant Starbucks after he has suffered lasting damage to his hands, genitals, stomach and thighs in an incident which took place at a California drive-through, KOVR reported.

According to The Sacramento Bee, the lawsuit in federal court in Sacramento claims that the lid “lost its seal with the cup lip” and fell off, leading to the hot spilling all over Tommy.

The alleged incident, which took place in 2018, meant the piping hot tea landed on the 22-year-old’s hand and “overturned on the window sill”. Tommy then found himself covered in hot tea across his “hands, stomach and pelvic area”, according to the suit.

Based on numerous reports, the tea is served at an extremely hot temperature of around 190 to 205 degrees.

Horrified by what had happened, Tommy claims he rushed out into the parking lot of Starbucks in Roseville and stripped off his clothes. He then rushed to the hospital.

The court documents state that by the times he arrived at the hospital, he had suffered “blistering” burns.

The man had been left scalded across his “lower left abdomen, thighs, penis, scrotum, peritoneum and buttocks”.

KOVR reported that Tommy was forced to stay in hospital for 11 days, within the burn unit.

Although he has now recovered from the traumatising incident, Tommy says he has suffered lasting damage.

Whitney Davis, his attorney, claims that her client can longer play the piano and finds intimacy “awkward and painful”.

Tommy, now 24, is suing Starbucks as he alleges that the company has had previous reports of burns due to lids coming off.

He is also suing Pactiv Packaging, as they provide the cups and lids.

Starbucks has stated that it is “evaluating the claim”, according to KOVR.

Starbucks has commented: “Our partners take great pride in ensuring our beverages are crafted with care and delivered to customers safely.

“We take our responsibility to provide a safe environment seriously and will continue to do so.”
