Nirvana is being sued by the baby from the ‘Nevermind’ album cover, according to reports. 

Spencer Elden, who is now 30, was just four months old when he was famously photographed reaching out for a dollar bill while underwater for the 1991 artwork.

Despite years having passed since the record’s release, the man is now claiming his parents never authorised the use of the photo and he feels it could be classed as child pornography.

It’s been argued by Elden’s lawyer that the dollar bill – which was photoshopped onto the image – suggests the infant is a ‘sex worker’.

Legal papers that have been filed in California also state the image ‘exposed Spencer’s intimate body part and lasciviously displayed Spencer’s genitals from the time he was an infant to the present day’.

The case alleges that Nirvana promised to cover the infant’s private area with some form of a sticker. However, this never happened.

Elden is reportedly asking for around $150,000 (£109,000) in damages from each of the defendants.

If he wins the case, surviving band members Dave Grohl and Krist Novoselic, the manager of Kurt Cobain’s estate, his former wife Courtney Love, and photographer Kirk Weddle will all be forced to make a payout.

Elden believes the sum is justified, as his ‘true identity and legal name are forever tied to the commercial sexual exploitation he experienced as a minor’. Plus, it has led to ‘lifelong damages’.

Prior to the lawsuit, the man reportedly recreated the album cover several times as he grew up.

In a 2015 interview with The Guardian, Elden said the iconic image ‘opened doors’ for him.

“It’s always been a positive thing and opened doors for me,” he said. “I’m 23 now and an artist and this story gave me an opportunity to work with Shepard Fairey for five years, which was an awesome experience. He is a huge music connoisseur: when he heard I was the Nirvana baby, he thought that was really cool.”
