Amber Heard has suffered another loss in Johnny Depp’s defamation trial against her, as the judge has reportedly rejected the actress’s request to have the case ‘thrown out’.

The Aquaman star’s lawyers asked Penney Azcarate to dismiss the case before beginning their argument, stating that there is ‘ample evidence’ to suggest that her ex-husband ‘abused her’ during their marriage, which is something that Depp has always denied.

Benjamin Rottenborn, Heard’s attorney, reportedly added that if Depp did abuse Heard ‘even one time,’ then ‘she wins’.

Watch the judge reject the request below…

“It’s that simple,” he said. “The court should grant the motion to strike because the undisputed evidence is that he did, in fact, abuse Amber.”

However, Ben Chew, who is Depp’s lawyer, argued back: “The court should deny Amber Heard’s motion to strike because Mr Depp has come forward in his case and chief with multiple credible witnesses, documents and authentic tape recordings of Ms Heard herself.”

He then raised his voice and pointed at Heard, adding: “Not only satisfying all of the requisite elements of his claim for defamation, including actual malice but also going the extra mile of showing Ms Heard physically abused him. She’s the abuser in this courtroom!”

In denying the request, the judge said: “If there is a scintilla of evidence that a reasonable juror could weigh, then the matter survives a motion to strike.”

Amber Heard’s Divorce ‘Demands’ From Johnny Depp Revealed

It comes as Drew Barrymore has apologised for comments she has made about the ongoing trial.

Earlier this week, the talk show host and actress labelled the former couple ‘crazy’ for disclosing information ‘publically’.

On her programme, she said: “I know that these are two people’s real lives and I know what it’s like to have your life put out in public.

“I understand all the feelings, but they are actually offering up this information that nobody had to know. This is crazy!”

However, the star took back her comments on Instagram, saying: “It has come to my attention that I have offended people by making light of Johnny Depp and Amber Heard and for that, I just want to deeply apologise and appreciate everyone who spoke out because this can be a teachable moment for me and how I move forward and how I conduct myself.”
